The other standard is strict liability. Under strict liability claims, injury victims do not have to demonstrate negligence to recover financial compensation. As long as the victim sustained injuries, the opposing party is automatically liable for the injuries. The most obvious example of strict liability is dog bite cases. In Arizona, individual dog owners are automatically liable if their dog bites someone, regardless of whether they were negligent.

How Long Do I Have to File a Personal Injury Lawsuit in Maricopa County?

In Arizona, you have two years to file most personal injury claims. This two-year counter starts from the day the injury occurred or the day you discovered the injury. Once the two years elapse, your legal claim to compensation will expire, and any lawsuit you file will be rejected. 

There are a few exceptions to this two-year limit for specific types of injury cases:

  • Dog bite claims are a matter of statutory liability, and have a one-year time limit.
  • There is a one-year time limit on claims against government employees or entities. You must also file a separate written notice of your intent to sue within 180 days.
